Many business owners mistakenly think they have protected their name because it is registered with the state as either an LLC, corporate name or trade name. Unfortunately, they could still receive a cease and desist letter from a competitor who has already registered it with the U.S. Patent and Trademark Office. And, if they don’t stop using their brand, they will face certain litigation.
